Fresh 9 GB PRICE RATE

Price Rate terms and conditions:

From November 4, 2011 individual customers who subscribe on the terms of contract may connect to «Fresh 9GB» tariff. After signing «Fresh 9GB» subscription contract subscriber receives nine gigabytes of traffic for use during a calendar month for 99 UAH.

If a subscriber buys a starter kit with Router or Outdoor modem on the terms of contract with a special (discounted) price, «Fresh 9GB» price rate will be 149 UAH a month.

A volume unit equal to 1 Kilobyte is used to count the volume of data transfer services. 1 GB is equal to 1,048,576 KB.

FreshHome PRICE RATE

Price Rate terms and conditions:

The FreshHome Price Rate offers a 20 Mb/s unlimited Internet access with the traffic volume of up to 20 GB for the period of a calendar month. After such 20 GB of traffic volume are exhausted during the relevant calendar month, any further Internet access is available at the download speed of up to 256 Kb/s and upload speed of up to 128 Kb/s.

A volume unit equal to 1 Kilobyte is used to count the volume of data transfer services. 1 GB is equal to 1,048,576 KB.

FreshFamily PRICE RATE

Price Rate terms and conditions:

The FreshFamily Price Rate offers an unlimited Internet access at the speed of up to 2 Mb/s with the traffic volume of up to 40 GB for the period of a calendar month. After such 40 GB of traffic volume are exhausted during the relevant calendar month, any further Internet access is available at the download speed of up to 256 Kb/s and upload speed of up to 128 Kb/s.

A volume unit equal to 1 Kilobyte is used to count the volume of data transfer services. 1 GB is equal to 1,048,576 KB.

FreshPremium PRICE RATE

Price Rate terms and conditions:

The FreshPremium Price Rate offers an unlimited Internet access at the speed of up to 20 Mb/s and with the traffic volume of up to 80 GB for the period of a calendar month. After such 80 GB of traffic volume are exhausted during the relevant calendar month, any further Internet access is available at the download speed of up to 512 Kb/s and upload speed of up to 256 Kb/s.

The FreshPremium Price Rate enables user’s higher priority Internet access. It means that, in case of the maximum number of multiple simultaneous Internet users, customers choosing this Price Rate are granted a warranted Internet access at the speed from 512 Kb/s.

A volume unit equal to 1 Kilobyte is used to count the volume of data transfer services. 1 GB is equal to 1,048,576 KB.

Price Rate payment terms and conditions:

1. A customer may purchase a Start Package with a device at a reduced price*. At the same time, the customer shall make payment of a monthly subscriber fee (hereinafter also referred to as "the Subscriber Fee"), which fee includes the special price rate cost (i.e. the cost of Internet access service). If the customer then chooses the FreshPremium Price Rate, the customer’s Subscriber Fee will be UAH 399 per month (inclusive of VAT). Such service terms and conditions are available and applicable to the extent the customer signs a Type A Subscriber’s Contract.
2. For contract customers, the relevant customer’s account is automatically debited for the amount of the Subscriber Fee on the 1st day of each month during the entire effective period of contract based subscription. Starting 04.11.11 each contract based subscription period continues for 12 months. At the time of customer’s first subscription, the full amount of the Subscriber Fee shall be paid by a customer. Where a customer makes such first subscription and chooses a Price Rate on any other day of a month after the 1st day of such month, the Subscriber Fee shall be debited in the amount proportional to the number of days until the end of such month.
3.  Credit. Whenever, on the 1st day of a month the balance of a customer’s account is insufficient to cover the Subscriber Fee, such customer’s account is debited for the amount available and credit for the required amount of the Subscriber Fee is granted, thus enabling customer’s unrestricted  Internet access in line with the relevant Price Rate until the 15th day of the then current month. After such 15th day, the customer has the possibility of the «Service Access» for the period of one month, that is until the 14th day (inclusive) of the next successive month. To avoid service termination, the credit so granted shall be redeemed and settled during the then current month.
4. «Service Access». The «Service Access» enables a 64 Kb/s Internet access. The «Service Access» is effective during one month, that is from the 15th day of a current month until the 14th day of the next successive month. Before the expiry of the of «Service Access» period, a customer shall redeem credit debts and ensure payment of the full Subscriber Fee for the next successive period. At the same time, as soon as the Subscriber Fee is debited, a customer is granted an unrestricted Internet access in line with the terms and conditions of such customer’s Price Rate.
5.  Disabled Service. If Price Rate payments for any previous periods are not made within the Service Access period, the Internet access service is disabled from the 15th day of the next successive month until the relevant customer redeems credit debts in full and ensures payment of the full Subscriber Fee for the next successive period. Beginning from the moment when the relevant services are disabled, a customer is charged a penalty (fine).
6. For the tariff Fresh 9Gb Credit period and «Service Access» mode are not available.

All Price Rate amounts are specified inclusive of the applicable VAT as of November 04, 2011.

Tariff change conditions for Contract subscribers.

• The migration to another tariffs is possible but after the paid period and not earlier than 30 days after first tariff activation. You need to order tariff change on the page My Account to the first day of next month
• Tariff change during a calendar month is possible only by calling to contact center. When you change the tariff in the middle of the month the cost of the new tariff one is charged from your account in proportion to the number of days until the end of the month. Payments for previous tariff plan does not return to your account.
• Cost UAH 30 (VAT incl)  is applied for the tariff change if your new tariff rate (monthly fee) is less than previous one. Vice versa migration is free of charge if new tariff has more package price (monthly fee) than previous one. The subscriber can choose one of the relevant tariff on the day of change, unless otherwise provided by the terms of the tariff.

PENALTY (Fine):

If a customer signing a Type A Subscriber’s Contract fails to comply with such customer’s respective duties and obligations under the Contract, a penalty (fine) is charged for a full month beginning from the 15th day when the Service Access period expires and if no sufficient amount to redeem credit debts is available on the customer’s amount. In that event, the fine so charged shall be equal to UAH 70 per month.

If a customer redeems credit debts and ensures Subscriber Fee payment during the Service Access period, no fine is charged for such period.

A fine is also charged in the event of any early termination of a Subscriber’s Contract. In such case, a customer shall:

• redeem all debts (if any) for the previous period; and

• pay the fine of UAH 70 per each remaining month of the relevant contract based service.

For instance, if a customer signing a Subscriber’s Contract prematurely terminates such Contract after 10 months of service, the fine shall be: 70*(12-10)= UAH 140.
